The following terms apply strictly to all auction-related services and must be read carefully before participating in any auction we are associated with.

1. Facilitator Role Only

Zamai Property Partners (SMC-Private) Limited acts exclusively as a facilitator and marketing agent for property auctions. We do not conduct auctions in our own name, hold auction proceeds, or act as an auctioneer in the legal sense unless separately licensed and appointed to do so in writing for a specific transaction.

2. No Warranty on Auction Properties

All properties listed or advertised for auction through our channels are sold or offered on an as-is, where-is basis. Zamai Property Partners (SMC-Private) Limited makes no representation, warranty, or guarantee regarding the physical condition, legal status, title, encumbrances, outstanding dues, approved use, or vacant possession of any property being auctioned.

3. Buyer’s Responsibility

It is the sole responsibility of the bidder or buyer to conduct thorough due diligence on any property before participating in an auction. This includes but is not limited to verifying ownership and title documents, checking for any mortgages, liens, or court orders on the property, confirming approval status with the relevant local authority, inspecting the physical condition of the property, and obtaining independent legal or financial advice.

Zamai Property Partners (SMC-Private) Limited shall not be held responsible for any loss, damage, dispute, or legal complication arising from a buyer’s failure to conduct adequate due diligence before bidding or purchasing at auction.

4. Auction Terms Set by Seller

The specific terms of each auction including reserve price, deposit requirements, payment schedule, and completion timeline are set by the instructing seller or their legal representative. Zamai Property Partners (SMC-Private) Limited is not responsible for enforcing, modifying, or guaranteeing those terms. Any disputes regarding auction terms must be resolved directly with the seller.

5. No Guarantee of Title or Possession

Zamai Property Partners (SMC-Private) Limited does not guarantee that the winning bidder will receive clear title, vacant possession, or timely transfer of any auctioned property. These are matters between the buyer and seller and any relevant legal or regulatory authority.

6. No Liability for Auction Outcome

Zamai Property Partners (SMC-Private) Limited shall not be liable for any financial loss, failed transaction, disputed ownership, delayed possession, or any other outcome arising from participation in any auction we have advertised or facilitated. Our liability is strictly limited to the facilitation and marketing services we provide and does not extend to the outcome of the auction itself.

7. Third-Party Auctions

Where we advertise or share information about auctions conducted by third parties including banks, courts, government bodies, or independent auctioneers, we do so purely for informational purposes. We have no involvement in, control over, or responsibility for those auctions and accept no liability in connection with them.

Fees and Commission
